Intellectual Property Protection

Whether trademarks, copyrights, logos, patents, databases, designs, services, and others, protecting your intangible assets allows you to have the sole legal, enforceable right of usage and benefits.

Patents issued by the United States Patent & Trade Office (USPTO) are only valid in the U.S. and patents granted by the European Patent Office (EPO) are only recognized by nations that have signed onto the Patent Cooperation Treaty (PCT).

To secure exclusive global rights to a new product can often require applying for patents in individual national jurisdictions. Under the guidelines of the 1970 Patent Cooperation Treaty (PCT), however, the World Intellectual Property Organization (WIPO) can issue so-called “International Patents” that gives inventors a first step in securing exclusive rights to their products in PCT signatory nations.

Patent protections are eligible for twenty years from the application date to receive the patent

France is a signatory to conventions such as the TRIPS Agreement, which guarantees intellectual property protection for foreign intellectual property rights. It has a unified patent registration scheme for companies, which offers even more international patent and foreign intellectual property protection. The authorities actively police IP infringement and issue fines of up to €7,500 for each violation and eventual permanent sanctions.

The Intellectual Property Code in France is now harmonized with international agreements regulating the protection of intellectual work. France has also signed the Berne Convention for the Protection of Literary and Artistic Works and the Universal Copyright Convention of Geneva. It also adheres to the World Intellectual Property Organization and, as an EU member state, France abides by all European Union’s Directives related to intellectual protection.

Europe Incorporations will check/verify that there are no conflicts and register your intellectual property at the French National Industrial Property Office, the European Patent Office, and even the global World Intellectual Property Organization for international patents. At the latter two organizations, it is an iterative process that takes some time to complete.
